Terms of Service

These terms cover your use of Thumbnailr. They're written to be readable, but they're still an agreement between you and us, so please read them. By using Thumbnailr you agree to them. If you don't agree, please don't use the service. Nothing in these terms takes away your legal rights as a consumer.

1. About us

Thumbnailr is provided by Wade Fletcher trading as Thumbnailr ("we", "us"), a sole trader in the United Kingdom. Contact: contact@thumbnailr.app. How we handle personal data is explained in our Privacy Policy. Thumbnailr is an independent tool and isn't affiliated with or endorsed by YouTube or Google.

2. Using Thumbnailr

• Thumbnailr is a thumbnail editor that runs in your web browser. You don't need an account to use it.
• The Free plan includes the full editor, the starter templates and 1280×720 PNG/JPG export with no watermark, and Series mode limited to 3 thumbnails per batch and 1 saved series.
• We keep improving Thumbnailr, so features may change. We'll try not to take away anything you rely on without good reason. If a change significantly reduces what Pro includes, we'll tell subscribers at least 30 days in advance, and you can cancel and get a refund for any period you've paid for but not yet used.

3. Your content

• Everything you create and upload stays yours. Because the editor runs in your browser, we never receive your images and claim no rights over them.
• You're responsible for having the rights to the images, logos and other material you use, and for following the rules of the platforms where you publish your thumbnails (for example YouTube's Community Guidelines).
• Projects are saved only in your browser. Clearing site data, using private browsing or switching devices or browsers can lose them, and because we never have a copy we can't restore them. Please export anything you want to keep, or use "Save project file" to keep an editable copy on your device.

4. Thumbnailr Pro

Pro adds: premium templates, on-device background removal, 4K (3840×2160) and WebP export, a brand kit (your colours, fonts, text style, logo and cut-outs, applied in one click), and unlimited Series batches downloaded as one ZIP of up to 200 thumbnails each (the free plan makes up to 3 thumbnails per batch and keeps 1 saved series). Background removal works best on clear photos of people, pets and products, and fine detail such as hair can come out a little soft.

Who you're buying from

• Pro is a monthly subscription sold by Lemon Squeezy as merchant of record. That means Lemon Squeezy is the seller: it takes your payment, charges VAT, and sends invoices and receipts, and its buyer terms apply to the purchase and payment. We provide the Pro features and support, and these terms apply to your use of them. If the two ever conflict about the Pro features themselves, the more favourable to you applies, and neither can take away your legal rights.
• The price, including VAT, is shown before you pay. Your subscription renews automatically every month, and you're charged on the same day each month until you cancel.

Cancelling

• You can cancel at any time in one step from the Lemon Squeezy customer portal (linked from your receipt emails and from "Manage subscription" in the editor), or by emailing us and we'll cancel it for you. Cancel before your renewal date and you won't be charged again. Pro then continues until the end of the month you've paid for. There are no cancellation fees.
• If you cancel by contacting Lemon Squeezy directly rather than using the portal, its buyer terms ask for at least 48 hours' notice before the renewal date, so the portal or emailing us is quickest.
• If we change the price, we'll email you at least 30 days before it applies, and it only applies from a billing date after that notice. You can cancel before it takes effect.

Your 14-day right to cancel and refunds

• 14-day money-back promise. If you're not happy with Pro, email us within 14 days of your first payment and we'll arrange a full refund of that payment through Lemon Squeezy, with no need to give a reason. Your Pro licence is switched off when the refund is made. This covers your rights to cancel a new subscription under the Consumer Contracts Regulations 2013, which give UK consumers 14 days to change their minds.
• Renewal payments aren't normally refundable once the new month has started, but you can cancel at any time to stop the next one.
• If Pro doesn't work as described, or isn't provided with reasonable care and skill, you have rights under the Consumer Rights Act 2015, such as a repair, a fix or a refund, whenever that happens. Nothing in these terms or in Lemon Squeezy's terms affects those rights. Email us and we'll put it right.

Licence keys

• After purchase you receive a licence key by email. Enter it in the editor (Upgrade → "I have a licence key") to unlock Pro in that browser.
• The key is for you, on your own devices, up to the number of activations shown at checkout. Please don't share or publish it. You can free up an activation with "Deactivate on this device".
• The editor checks your licence with Lemon Squeezy from time to time. If you're offline, Pro keeps working for up to 7 days after the last successful check. If the subscription is cancelled and runs out, expires or is refunded, Pro switches off and the editor goes back to the Free plan. Your projects aren't affected.

5. Templates, fonts and other assets

• You can use thumbnails you make with our templates for any purpose, including on monetised and commercial channels. You may not resell or redistribute the templates themselves as templates.
• Thumbnailr includes open-source components under their own licences: display fonts (SIL Open Font Licence / Apache 2.0), ONNX Runtime Web (MIT) and the U²-Net background-removal model (Apache 2.0).

6. Fair use

Please don't use Thumbnailr to make anything unlawful, infringing, hateful or deceptive. Don't try to disrupt or overload the service. Don't share licence keys, or get around the Pro licence checks or the Free plan limits. If someone seriously or repeatedly breaks these terms, we may stop their Pro licence; we'll tell them why and refund any period they've paid for but not used.

7. Our responsibility to you

• We provide Thumbnailr with reasonable care and skill, but we can't promise it will always be available or error-free, or that background removal will be perfect for every image.
• We're responsible for loss you suffer that is a foreseeable result of us breaking these terms or not using reasonable care and skill. We're not responsible for loss that wasn't foreseeable.
• If faulty Thumbnailr software damages your device or other digital content, and that's because we didn't use reasonable care and skill, we'll either fix the damage or compensate you. As projects live only in your browser, the best protection is to export anything you want to keep.
• If you use Thumbnailr for a business (for example, to make money from a channel), we aren't responsible for business losses such as lost profit, revenue, views or business opportunity, and our total liability to you is limited to the amount you paid for Pro in the 12 months before the claim.
• Nothing in these terms limits liability that the law doesn't allow us to limit. That includes liability for death or personal injury caused by negligence, for fraud, and for your rights as a consumer under the Consumer Rights Act 2015.

8. Changes to these terms

We may update these terms, for example when we add features or the law changes. We'll change the date at the top, and we'll email Pro subscribers about any significant change at least 30 days before it takes effect. If you don't like a change, you can cancel before it applies.

9. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and the consumer protection laws of the part of the UK where you live still apply to you.
